The newly approved transfer of development rights sending overlay district will change nothing regarding how the Town administers the program. The TDR-S will be another layer of zoning apart from the existing sending and receiving districts.

There were about 12 land owners at a recent informational hearing, said Town Chairman Kris Hampton at the September 19 Board meeting where the county petition was approved. "Everyone had their questions answered and nobody opted out of the program.

The TDR-S overlay district makes the entire Town a sending district. Sending districts are areas restricted from residential development with the exception of an option to use development rights to rezone up to a two acre parcel for every 35 acres of a landowner’s agricultural land. At the other end are the receiving districts, which are land segments open for residential development. To do this receiving district landowners purchase development rights from sending district landowners.

The goal of the program is farmland preservation—discouraging residential development on valuable agricultural land and concentrating new construction in the urbanized areas. Much of the Town's receiving district land is found skirting urban areas, and in Cottage Grove’s case they are located primarily around the Village border.
